ets member waiver

This WAIVER AGREEMENT (“Agreement”) is entered into as of __________________, between Endurance Society Sports Coaching Services L.L.C (ETS) and _________________________________ (Member).
The Member agrees that:
a. By using any of ETS services the Member confirms that he/she has read the terms and conditions herein and accepts them as a legal and binding contract.
b. He/she is of legal age and capacity and has voluntarily entered into this agreement; if he/she is not of legal age, a parent/guardian must consent to entering into this agreement on his/her behalf.
Waiver and Release of Liability
I ___________________________, age _____________________ am fully aware that participating in any exercise program can be a potentially dangerous and hazardous activity. The Member is specifically aware of the potential dangers of participating in any events and activities ETS may organize (“Activities”) and he/she shall assess his/her suitability to engage in any/each of these Activities and assume total responsibility should he/she decides to proceed.

In consideration of the Member’s acceptance into the ETS Activities, the Member, the undersigned (parent or guardian if participant is under 18 years of age) intending to be legally bound, do hereby for him/herself, his/her heirs, executors, administrators, and assigns, assumes any and all risks of participating in said Activities, and he/she hereby waives and releases any and all rights and claims for damages he/she has against ETS, its representatives, successors, and assigns for any and all injuries, all such risks being known and appreciated by the Member.

The Member hereby waives and releases the above entities, their representatives, employees, successors, and assigns from any and all claims or liabilities of any kind arising out of his/her participation in Activities, even though these claims and liabilities might arise out of the negligence or carelessness on the part of the persons named above.

The Member attests and verifies that he/she is physically fit and prepared for the ETS Activities, and that a licensed medical doctor has verified his/her physical condition within the last six months.

The Member hereby assumes full responsibility from any injury, including his/her death occurring while participating in, or as a result of, participating in the ETS Activities, and
hereby releases, waives, discharges and covenants not to sue ETS and its successors, representatives, employees, assigns, or other participants in the ETS Activities from any and all liability to himself/herself, his/her personal representatives, heirs, successors, and assigns for any loss or damage and claim or demands therefore on account of injury to himself/herself, including his/her death, whether caused by their negligence or carelessness in advising him/her while participating in ETS Activities.

The member hereby grant ETS and its representatives the irrevocable and unrestricted right to photograph and/or record me during my participation in gym activities. I understand that these photographs and/or recordings may be used for promotional materials, marketing, social media, or other purposes without any compensation to me. I waive any right to inspect or approve the finished photographs or recordings or the use to which they may be applied. I release ETS, its employees, and any third parties acting under its authority from any liability concerning the use or publication of such photographs and/or recordings.

• United Arab of Emirates is our country of domicile” and stipulate that the governing law is the local law.
• Any purchase, dispute or claim arising out of or in connection with this website shall be governed and construed in accordance with the laws of UAE.
• Visa or MasterCard debit and credit cards in AED will be accepted for payment.
• The displayed price and currency at the checkout page, will be the same price and currency printed on the Transaction Receipt and the amount charged to the card will be shown in your card currency.
• We will not trade with or provide any services to OFAC and sanctioned countries.
• Cardholder must retain a copy of transaction records and https://endurancets.com policies and rules.
• User is responsible for maintaining the confidentiality of his account.

Payment Confirmation

The customer will receive an email confirmation that the payment has been received through info@endurancets.com

For services:

• The customer will automatically received an email from our website at https://endurancets.com after they completed the payment. This email includes the order details. 
• Payments are typically processed within 24 hours.  However, during peak times, it may take up to 48 hours for your payment to be processed. 

Return/Refund Policy

• Memberships, subscriptions and packages will not be refunded under any circumstances.
• All members may choose to exercise the right to freeze their membership for a maximum duration of 1 month during any 12-month period.

Loyalty Member Discount Policy
Excluding the case of injury or significant illness, as verified via a medical certificate, suspension of more than 1 month during any 12-month period will result in that members status becoming “inactive” forfeiting their loyalty discount and being required to re-join on the current club membership rates.

Inactivity Policy
Any member who is inactive for a period greater than 1 month will become ineligible for any club partner discount, training camp and apparel discounts and removed from all membership communication channels.

Cancelation Policy:

• Cancellation of subscription. We or you may terminate or cancel your subscription to the services at any time and such termination or cancellation, shall be effective upon the end of your then-current subscription term.
• You can cancel your subscription by contacting us at info@endurancets.com or by such other means as we may provide from time to time.
• We will attempt to process all cancellation request within 72 hours after we receive your request.
• If you cancel less than 72 hours before the next relevant billing period begins, you agree that you will be liable for the subsequent subscription fee for such billing period, and are not entitled to a refund of that final subscription fee.
• We reserve the right to collect fees, surcharges or cost incurred before your cancellation takes effect.
• Group Class bookings have a 10-hours cancellation policy prior to the class. Failure to cancel a class booking before the cancellation window, will result in the loss of 1 session in the case where the member holds a session based package.
