ETS Member Waiver & Agreement

Endurance Society Sports Coaching Services L.L.C (ETS) 

By submitting this form, you (“Member”) confirm that you have read, understood, and agree to the following terms and conditions. This Agreement constitutes a legally binding contract between you and Endurance Society Sports Coaching Services L.L.C (ETS). 

  1. Eligibility and Acceptance
  • You confirm that you are of legal age and have the capacity to enter into this Agreement. 
  • If you are under 18 years of age, a parent or legal guardian must provide consent on your behalf. 
  • By participating in any ETS services, sessions, events, coaching, training plans, or activities (“Activities”), you agree to be bound by this Agreement. 
  1. Assumption of Risk

You acknowledge and understand that participation in physical training, coaching, endurance sports, and related Activities involves inherent risks, including but not limited to: 

  • Physical injury 
  • Illness 
  • Accidents 
  • Collisions 
  • Environmental hazards 
  • In rare cases, serious injury or death 

You acknowledge that ETS Activities may take place outdoors and may involve exposure to: 

  • Heat and humidity 
  • Traffic and road hazards 
  • Open water environments 
  • Weather conditions 
  • Other environmental risks associated with endurance sports training 

You acknowledge that certain Activities, including open water swimming, may involve additional risks including: 

  • Currents 
  • Marine life 
  • Limited visibility 
  • Water quality conditions 
  • Drowning risk 
  • Changing environmental conditions 

You confirm that: 

  • You are physically fit and able to participate in ETS Activities. 
  • You voluntarily assume full responsibility for any risks associated with your participation. 
  • You will seek medical advice where necessary before participating. 
  1. Medical Responsibility

You confirm that: 

  • You are responsible for monitoring your own physical condition. 
  • You will immediately stop any activity if you feel unwell, injured, or at risk. 
  • You accept full responsibility for any injury or health issue arising from participation. 
  • You agree to disclose any medical conditions, injuries, illnesses, or other health concerns that may affect your ability to participate safely in ETS Activities. 
  1. Safety Compliance
  • Members agree to follow all instructions, safety guidance, rules, and directions provided by ETS coaches and staff during Activities. 
  • ETS reserves the right to remove any participant acting in an unsafe, abusive, threatening, discriminatory, or disruptive manner without refund. 
  1. Waiver and Release of Liability

In consideration of being permitted to participate in ETS Activities, you agree: 

  • To waive, release, and discharge ETS, its owners, employees, coaches, representatives, contractors, partners, sponsors, venues, affiliates, and representatives from any and all liability, claims, demands, damages, or causes of action arising out of or related to any injury, loss, illness, damage, or death resulting from participation in ETS Activities. 
  • This includes, to the fullest extent permitted by applicable law, claims arising from negligence. 

You agree that this waiver applies to: 

  • Yourself 
  • Your heirs, executors, administrators, and assigns 
  1. Emergency Medical Treatment
  • In the event of an accident, injury, or medical emergency during participation in ETS Activities, you authorise ETS and its representatives to obtain emergency medical treatment on your behalf if necessary. 
  • You acknowledge that any associated medical, ambulance, hospital, or treatment costs remain your responsibility. 
  1. Coaching & Training Advice
  • ETS coaching, training plans, feedback, recommendations, and performance guidance are provided for general educational and athletic performance purposes only. 
  • ETS does not provide medical, physiotherapy, nutritional, or psychological advice unless explicitly stated. 
  • Members should seek qualified professional advice for medical or health-related concerns. 
  1. Independent Training
  • Members acknowledge that they may perform training sessions independently without direct supervision from ETS coaches or staff. 
  • Members accept full responsibility for completing training sessions safely, including selecting appropriate routes, environments, equipment, hydration, nutrition, and weather conditions. 
  1. Equipment Responsibility
  • Members are responsible for ensuring that their equipment, including bicycles, helmets, footwear, and other training gear, is maintained in a safe and suitable condition for participation in Activities. 
  • ETS reserves the right to refuse participation where equipment is considered unsafe. 
  1. No Guarantee of Results
  • ETS does not guarantee specific athletic, performance, health, or competition results from participation in coaching or training programs. 
  • Individual results may vary depending on training consistency, health, recovery, lifestyle, and other factors outside the control of ETS. 
  1. Payments and Transactions
  • Payments are accepted via Visa and MasterCard in AED. 
  • Memberships and subscriptions are recurring unless cancelled in accordance with this Agreement. 
  • The price displayed at checkout will match the transaction receipt. 
  • Payment confirmations will be sent via email. 
  • Payments are typically processed within 24 hours (up to 48 hours during peak periods). 
  • You agree to retain records of your transactions and review ETS policies available at:

  1. Refund Policy
  • Memberships, subscriptions, coaching services, and packages are non-refundable and non-transferable under any circumstances unless otherwise required by UAE law. 
  1. Membership Pause Policy
  • Members may pause their membership for a maximum of 1 month within any 12-month period. 
  • During the pause period, membership payments will continue as normal, and the paused month will be added to the end of the membership term. 
  • Membership pause requests must be submitted in writing prior to the requested pause period to info@endurancets.com. 
  1. Loyalty Discount Policy

Suspensions longer than 1 month (excluding verified medical reasons) may result in: 

  • Loss of loyalty discounts 
  • Rejoining at current membership rates 
  1. Inactivity Policy
  • Members with no active membership or subscription for more than 1 month may lose eligibility for partner discounts, promotional offers, and member communications. 
  1. Cancellation Policy
  • Subscriptions may be cancelled at any time via the website at:

  • Cancellation takes effect at the end of the current billing period. 
  • Cancellations are processed within 72 hours. 

You agree that: 

  • Cancelling less than 72 hours before the next billing cycle may result in being charged for the next billing period. 
  • No refunds will be issued for that billing period. 
  1. Class Booking Policy
  • Group sessions require a minimum of 10 hours’ notice for cancellation. 
  • Failure to cancel within this window may result in the loss of a session for session-based packages. 
  1. Session Cancellations & Weather
  • ETS reserves the right to cancel, reschedule, relocate, shorten, or modify sessions due to weather, safety concerns, coach availability, facility availability, or other circumstances outside of its control. 
  • No refunds or credits will be provided unless determined at the sole discretion of ETS. 
  1. Membership & Service Changes
  • ETS reserves the right to modify coaching schedules, session times, coaches, training locations, pricing, membership inclusions, and services where reasonably necessary for operational purposes. 
  • Members will be notified of significant changes where reasonably possible. 
  1. Media Consent

You grant ETS the irrevocable and unrestricted right to: 

  • Photograph, film, and/or record you during participation in Activities. 
  • Use such photographs, videos, recordings, and other media featuring you for marketing, advertising, promotional materials, social media content, website content, printed materials, and other business purposes. 

You agree that: 

  • No compensation will be provided for such use. 
  • You waive the right to inspect, review, or approve the final content. 
  • You release ETS from any liability related to the creation, publication, or use of such media. 
  • This consent remains valid unless withdrawn in writing, provided that any media already published may continue to be used by ETS. 
  1. Data Protection, Privacy & Communications

By joining ETS, you consent to ETS collecting, storing, processing, and using your personal information for purposes including: 

  • Membership administration 
  • Coaching and athlete management 
  • Session bookings and attendance tracking 
  • Payment processing 
  • Communication regarding ETS services 
  • Health and emergency information where provided by you 
  • Compliance with legal and regulatory obligations 

You further consent to being contacted by: 

  • Email 
  • Telephone 
  • WhatsApp 
  • SMS 
  • Other electronic communication methods regarding memberships, coaching, bookings, updates, promotions, events, and operational matters. 

You acknowledge that: 

  • ETS will take reasonable steps to protect personal information in accordance with applicable UAE laws. 
  • Personal information may be shared with coaches, staff, service providers, payment processors, booking systems, and other third parties where reasonably necessary for the operation of ETS services. 
  • You may request access to, correction of, or deletion of your personal information where permitted by applicable law. 
  1. Personal Property
  • ETS is not responsible for the loss, theft, or damage of any personal belongings, equipment, bicycles, vehicles, or valuables brought to training sessions, events, or facilities. 
  1. Member Conduct
  • Members are expected to behave respectfully towards coaches, staff, training partners, venues, and the wider public during ETS Activities. 
  • Harassment, discrimination, abusive behaviour, dangerous conduct, or repeated disruption may result in suspension or termination of membership without refund. 
  1. Third-Party Facilities & Services
  • Certain ETS Activities may take place at third-party venues or involve third-party service providers. 
  • ETS is not responsible for the acts, omissions, facilities, services, equipment, or safety standards of third parties. 
  1. Right to Refuse or Terminate Membership
  • ETS reserves the right to refuse, suspend, or terminate membership or participation at its discretion where a member’s conduct is deemed unsafe, abusive, threatening, discriminatory, disruptive, or otherwise inconsistent with the values of ETS. 
  1. Legal Jurisdiction
  • The United Arab Emirates is the country of domicile. 
  • This Agreement shall be governed by and interpreted in accordance with the laws of the United Arab Emirates. 
  • Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the courts of the United Arab Emirates. 
  1. Severability
  • If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. 
  1. Final Agreement

By submitting this form, you confirm that: 

  • You have read and understood this Agreement in full. 
  • You voluntarily agree to all terms. 
  • You accept this as a legally binding agreement.
